Allgemeine Geschäftsbedingungen für illegalin.eu

⚠ Important: Many of our customers live in legally vulnerable situations. These Terms are written in plain language to be understood by people in difficult circumstances. If anything is unclear, write to support@kiero.ch before you buy.

§1 Who we are and what we sell

These Terms govern every purchase made through illegalin.eu and the KIERO Partner Portal. The seller is Verein KI|E|RO Solutions, a Swiss non-profit association registered in Thun (HR-Nr. CH-036.6.104.113-3, UID CHE-449.056.305).

We sell four kinds of products:

  1. Digital books and guides — primarily The Spanish Bridge (€47).
  2. The KIERO Franchise License — a one-time affiliate access fee (€495) granting commission rights on our product catalog.
  3. Migration and legalisation services — visa assessments, business plans, legal filings, language packages, relocation support (€99 – €108,000+).
  4. Partner referrals — services delivered by trusted third parties (language schools, lawyers) for which we are the contractual mediator.

§2 We do not encourage illegal migration

Our products are written exclusively for people already living in Europe without papers. They explain existing legal mechanisms that allow undocumented persons to regularise their status. We do not advise, suggest or assist:

  • Crossing borders illegally;
  • Overstaying visas;
  • Falsifying documents;
  • Marriage of convenience;
  • Identity fraud of any kind.

By purchasing, you confirm that you are using our materials to regularise an existing situation, not to create one.

§3 No guarantee of outcome

Immigration decisions are made by national authorities, not by KIERO. We provide information, preparation, and legal accompaniment — we do not guarantee that any specific application will be approved. Our role is to maximise your chances by:

  • Selecting the right legal pathway for your situation;
  • Preparing complete, correct documentation;
  • Connecting you to qualified lawyers when needed;
  • Providing the financial means (via the franchise) to wait out timelines without falling into illegal work.

Refunds based on outcome are governed strictly by §6 and the specific product page at the time of purchase.

§4 Contract formation and prices

The display of products does not constitute a binding offer. By clicking the order button, you make a binding offer. The contract forms when we confirm by e-mail. All prices are in Euro (€) and include applicable Swiss VAT where due. The price valid is the price displayed at the moment of order confirmation.

Accepted payment methods: Visa, Mastercard, American Express, SEPA direct debit, PayPal, and selected cryptocurrencies. Digital deliverables are released immediately upon payment confirmation.

§5 The Spanish Bridge — book purchase

  • You receive a PDF (DE / EN / ES) with no DRM, downloadable as often as you wish.
  • The book and its updates remain accessible to you for life through the customer portal.
  • 30-day, no-questions-asked refund: if within 30 days of purchase you decide it is not what you expected, write to support@kiero.ch and we refund €47 in full.
  • You may not republish, resell, or distribute the PDF. Personal use only.

§6 KIERO Franchise License — special terms

The Franchise is a hybrid product. It is not a passive investment, an MLM scheme, or a pyramid. It is an affiliate access right tied to a personal migration commitment.

6.1 The 4-month migration commitment

When you pay the €495 entry fee, you commit to starting your own KIERO migration process within 4 months. "Starting" means: (a) completing the Migration Plan call with your assigned Advisor, and (b) booking your departure date or pre-departure language module.

If you have not started within 4 months, the franchise is automatically suspended. €396 (€495 minus €99 setup) is refunded within 14 days to the original payment method. All commissions you have already earned are paid out in full.

6.2 Commission structure

Commissions are not a salary. They are Vermittlungsprovisionen (referral fees) within the meaning of Art. 412 ff. of the Swiss Code of Obligations, paid by the Swiss Verein to you as an independent intermediary. The specific percentages (50% on book sales, 50% on franchise referrals, 20% on premium packages) are displayed on the Franchise page and may be updated with 30 days' notice.

Earning these commissions does not constitute employment in your country of residence and does not require a work permit. You are personally responsible for declaring this income to the tax authorities applicable to you.

6.3 Payouts

Commissions accrue in real time in your Partner Portal. Payouts run monthly via SEPA, PayPal, or supported stablecoin. Minimum payout: €50. We may delay an individual payout up to 60 days if we suspect fraud, refund disputes, or chargebacks on the underlying sale.

6.4 What you may NOT do as a franchisee

  • Promise specific legalisation outcomes — only KIERO's qualified lawyers may do so case-by-case.
  • Sell to people outside Europe with the intent of inducing illegal migration. The Franchise is strictly for those already in Europe.
  • Run paid advertising on Google, Meta or other platforms without prior written consent (their policies forbid targeting undocumented persons; violations endanger our access).
  • Use the KIERO trademark or assets in any context unrelated to your franchise activity.
  • Disclose other franchisees' or customers' personal data.

Violation of any of the above terminates your franchise immediately and forfeits any unpaid commissions.

§7 Migration and legalisation services

Higher-value services (visa assessments, business plans, full legalisation packages) are delivered by KIERO staff or contracted lawyers. Specific deliverables and timelines are set out in your individual service agreement at the time of order.

Refund policy for service products:

  • Before work begins: 100% refund.
  • After initial consultation but before filing: pro-rated refund minus consultation hours billed at €120/h.
  • After official filing: no refund. Filing fees paid to authorities are never refundable in any jurisdiction.

§8 Anonymity and data sensitivity

We understand that many customers are at active legal risk in their country of residence. Therefore:

  • We never share customer data with national immigration or police authorities of any country unless legally compelled by a Swiss court order.
  • We do not collect immigration-status fields in any form. You self-identify only as much as you choose.
  • You may purchase under a pseudonym for the book. For services that require legal filings, identity verification becomes necessary.
  • Communications run over encrypted channels (TLS 1.3, optional Signal for sensitive case discussions).

§9 Intellectual property

The KIERO method, the "Spanish Bridge" book, the franchise materials, the Partner Portal, all training scripts, marketing assets and the KIERO trademark belong to KI|E|RO Solutions. Your purchase grants a personal, non-transferable license to use them — not to resell, republish, modify or sublicense them. Franchisees receive a broader marketing-use license, scoped to their own customer acquisition activities, valid for as long as the franchise is active.

§10 Limitation of liability

KIERO is liable only for damages caused by intent or gross negligence. We are not liable for: changes in immigration law of any country (force majeure), decisions of immigration authorities, your inability to learn the local language, your decision to migrate or to remain, or the personal conduct of partner lawyers/schools (whose own liability rules apply). Maximum liability in any case is capped at the amount you paid us in the 12 months preceding the claim.

§11 Force majeure and sudden law changes

Immigration law changes frequently. If a national law change makes a legal pathway impossible after you have started your process, we will (a) offer you a free re-routing to a still-viable pathway, or (b) refund unbilled portions of your service fees. Filing fees already paid to authorities are not recoverable.

§12 Age and capacity

You must be at least 18 years old to purchase. If you are buying for or on behalf of a family that includes minors, you remain solely responsible for any consequences for those minors.

§13 Termination by us

We may terminate any contract immediately and without refund if we discover that you have provided false information, attempted fraud against KIERO or other customers, used KIERO assets for purposes other than legal regularisation, or violated the §6.4 prohibitions.

§14 Dispute resolution

Before going to court, we both agree to attempt good-faith resolution through support@kiero.ch and, if needed, the Swiss Schlichtungsbehörde of the canton of Bern.

§15 Governing law and venue

Swiss substantive law applies; the UN Sales Convention (CISG) is excluded. Exclusive venue is Thun, Switzerland — unless you are a consumer and mandatory consumer-protection rules of your country of habitual residence provide otherwise.

§16 Severability and updates

If a clause is invalid, the rest stays in force. We may update these Terms; the version in effect at the time of your purchase governs that purchase. For active franchisees, material changes will be communicated by e-mail at least 30 days in advance.
